AttendOS Terms of Service

By accessing or using AttendOS, creating an account, creating an event, or accepting these Terms, you agree to be bound by the Terms of Use, Content Rules, Privacy Policy, and additional terms explicitly presented for a specific feature or service.

If you use AttendOS on behalf of an organization, you affirm that you have the authority to bind that organization. In that case, “you” includes the relevant organization.

If you do not agree, you may not use the service.

AttendOS provides technological tools for event creation, registration, information dissemination, QR code issuance, check-in, attendee management, and related functions.

AttendOS is not inherently the event organizer, venue owner, event service provider, travel agent, insurance company, or safety guarantor for the event.

You must be at least 16 years old and have the necessary legal capacity to accept these Terms.

If the laws in your place of residence require a higher age or the consent of a legal representative, that requirement applies.

AttendOS is not designed as a direct service for children below the legal age permitted to provide data or enter into agreements independently.

You must:

• provide accurate account information;
• protect login credentials;
• not share your account without authorization;
• notify immediately upon suspicion of unauthorized access;
• ensure that authorized persons in the workspace only have necessary permissions;
• be responsible for activities conducted through your account, unless otherwise provided by law.

AttendOS may request identity or representation verification when necessary to protect accounts, attendees, or the platform.

Workspace owners or administrators may invite members and assign permissions.

The organization is responsible for:

• selecting who is granted permissions;
• managing the revocation of access;
• ensuring internal guidelines;
• handling disputes between members;
• protecting attendee data accessed through the workspace.

AttendOS may rely on instructions from individuals with system-recognized roles, unless valid notice of usurpation or control dispute is provided.

The Organizer is responsible for:

• the legality and accuracy of the event;
• necessary permits, insurance, or approvals;
• on-site safety;
• personnel, vendors, and volunteers;
• accessibility;
• cancellation or refund policies;
• the provision of advertised services;
• notifying attendees;
• emergency response;
• compliance with laws regarding children, health, food, alcohol, transportation, or specialized activities, if applicable.

AttendOS does not guarantee that the event will take place, reach registration numbers, be safe, suitable, or meet attendee expectations.

You retain ownership of the content you post.

You grant AttendOS a non-exclusive, worldwide, and sublicensable license to service providers, for the time necessary to:

• store;
• technically reproduce;
• format;
• transcode;
• transmit;
• display;
• distribute as directed by you;
• backup;
• secure;
• moderate;
• provide and improve service functionality.

This license is solely for operating, protecting, and providing AttendOS, and does not transfer ownership of your content to AttendOS.

You confirm that you have the necessary rights and permissions for the content posted.

You must comply with the AttendOS Content Guidelines.

AttendOS may review, restrict, remove, or refuse content where there is a reasonable basis to believe that the content:

• violates the Terms;
• violates the Content Guidelines;
• violates the law;
• infringes on the rights of others;
• creates risk for users, AttendOS, or third parties;
• could undermine the integrity or security of the service.

For attendee data collected by the organizer, the legal roles of AttendOS and the organizer may vary depending on the processing activity and applicable law.

The organizer is responsible for:

• determining what data is actually necessary;
• providing appropriate notice;
• having the necessary legal basis or consent;
• establishing access rights;
• processing attendee requests when it is the party determining the purpose of use;
• not using data for purposes not disclosed;
• not importing contact lists obtained unlawfully.

When necessary, AttendOS may provide a separate data processing agreement.

You may only send messages to recipients when you have the appropriate rights and basis.

You must:

• correctly identify the sender;
• not use misleading headers;
• honor unsubscribe requests;
• comply with anti-spam and marketing laws;
• not send prohibited content;
• ensure contact data is lawfully collected.

AttendOS may limit sending rates, pause campaigns, or request verification when abuse risk is detected.

Prices, attendee limits, features, and usage terms are presented prior to purchase.

Unless otherwise described:

• fees are charged per event or selected plan;
• taxes may be added as required by law;
• third-party payment processing fees may apply;
• incurred fees are non-refundable, unless required by refund policy or law;
• failure to fully utilize limits does not automatically entitle a refund.

If AttendOS offers recurring plans, conditions for renewal, cancellation, and billing schedule must be clearly displayed before the user subscribes.

Payments may be processed by an independent payment provider.

AttendOS may not directly store full payment card information.

The use of payment services may be subject to the provider's own terms and policies. AttendOS is not responsible for actions outside of its reasonable control, but will fulfill obligations as required by applicable law.

Unless AttendOS directly sells tickets as a clearly identified seller, the organizer is responsible for cancellation, refund, and dispute policies with attendees.

AttendOS may provide technical tools but does not automatically become the party responsible for event refunds.

If AttendOS directly charges fees for platform services, AttendOS's refund policy applies only to those platform fees.

AttendOS may integrate with email, payment, mapping, storage, analytics, AI, or other services.

Third-party services:

• may have their own terms;
• may change or cease operation;
• may process data as permitted by instructions;
• are not entirely under AttendOS's control.

AttendOS does not guarantee the perpetual availability of any integration.

AttendOS may provide AI functionality to suggest text, images, layouts, or workflows.

AI results may be inaccurate, incomplete, or inappropriate.

You are responsible for:

• reviewing results before use or publication;
• verifying dates, times, locations, policies, and critical information;
• ensuring you have the right to use input content;
• not entering sensitive data unnecessarily;
• not relying on AI to replace legal, medical, financial, or expert advice.

AttendOS does not automatically publish AI content without user confirmation, unless an automated function is explicitly and actively configured by the user.

You must not:

• damage or overload the system;
• gain unauthorized access;
• attempt to obtain source code not publicly provided;
• circumvent security or usage limitations;
• use the service to distribute malicious code;
• resell the service without an agreement;
• use data to build unauthorized competing products;
• conduct security testing that causes impact without permission;
• use AttendOS contrary to applicable sanctions or export controls.

AttendOS and its licensors own the platform, software, system design, trademarks, documentation, and non-user content components.

No rights are transferred beyond the limited right of use under these Terms.

If you voluntarily submit ideas or feedback, AttendOS may use that feedback to improve the product without remuneration, provided that AttendOS does not publicly disclose confidential information or personal data contrary to the Privacy Policy.

You may stop using or close your account using the provided functionality.

AttendOS may restrict, suspend, or terminate access when:

• there is a serious or repeated breach;
• safety or security needs protection;
• required by law or valid order;
• overdue fees are not paid;
• continued provision of services creates serious legal or technical risks.

Where appropriate, AttendOS will provide notice and an opportunity to remedy or request review.

Depending on your plan and account status, you may export data using the provided functionalities.

Following termination, data may be retained for a limited period to:

• allow for recovery;
• meet legal obligations;
• resolve disputes;
• prevent fraud;
• maintain cyclical backups;
• enforce the Terms.

Details are described in the Privacy Policy and applicable data retention schedule.

AttendOS may improve, add, change, or discontinue a feature.

For changes that materially affect a paid service, AttendOS will provide reasonable notice where possible.

AttendOS strives to operate a reliable service but cannot guarantee that the service will always be uninterrupted or error-free.

Incidents may arise from maintenance, network issues, equipment failures, third-party services, natural disasters, cyberattacks, or causes beyond reasonable control.

No transmission or storage system is absolutely secure.

To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis.

AttendOS makes no implied warranties beyond those that cannot be excluded under applicable law.

No provision excludes mandatory consumer rights.

To the extent permitted by law, AttendOS shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities arising from the use of the services.

AttendOS's total liability arising from the services shall not exceed the greater of:

• the fees you paid to AttendOS in the twelve months preceding the event giving rise to the claim; or
• any other minimum liability amount required by law.

This limitation does not apply where prohibited by law, including for liability that cannot be excluded for fraud, willful misconduct, or mandatory consumer rights.

To the extent permitted by law, the organization or business user agrees to defend and indemnify AttendOS against third-party claims arising from:

• its events;
• its content;
• its breach of the Terms;
• its violation of law;
• its infringement of another's rights.

This provision does not apply beyond the limits permitted by law for individual consumers.

The governing law, dispute resolution venue, arbitration, right to opt-out of arbitration, and consumer exceptions must be populated from the attorney-approved legal configuration:

Do not automatically apply an arbitration clause or class action waiver globally without attorney approval and implementation of the necessary notice, opt-out, or consent mechanisms.

Mandatory rights in the consumer's place of residence are reserved.

AttendOS may send notices via:

• email;
• in-product notification;
• account address;
• other methods permitted by law.

You are responsible for maintaining current contact information.

AttendOS may update these Terms.

If a change is material, AttendOS will provide reasonable notice before the change takes effect, except where immediate changes are required by law, security, or to prevent abuse.

Continued use after the effective date constitutes acceptance to the extent permitted by law. Where new consent is required by law, AttendOS will request affirmative action.

If a provision is unenforceable, the remaining provisions remain in effect.

Failure to immediately enforce a right does not constitute a waiver of that right.

You may not assign the Terms without consent if the assignment changes the responsible party. AttendOS may assign in connection with a merger, restructuring, or business transfer, provided it complies with the law.
